Terms and Conditions of Sale and Use (TCS/TUS) of Platinum Paris

RESERVATION

​

To book and/or pay for a service, the Client must be of legal age or an emancipated minor, be legally capable of contracting, and comply with these General Terms and Conditions of Sale and Use.

The Client is responsible for the reservations made in his name or on behalf of the Passengers when acting on their behalf. The Client guarantees the truthfulness and accuracy of the information provided.

RESERVATION REQUEST

​

A service reservation request can be made by phone, email, through the website www.platinum-paris.com, and by any other means approved by Platinum Paris. When made by phone, the reservation request must be confirmed in writing, notably by email or through the Platinum Paris website.

The reservation request must include the following minimum information:

Dates, times, and itineraries:

  • The date, time, and location of the initial pick-up of the Passenger(s)

  • The final drop-off location and any intermediate stops to be observed, if any

  • The number of people to be transported (specify if the passenger has reduced mobility and/or is in a wheelchair)

  • The approximate number, weight, and overall volume of luggage

Communication methods:

  • Passenger's phone number

  • Passenger's email

  • Desired vehicle model or category

For any new Client, the reservation will only be confirmed after Platinum Paris verifies their means of payment (see the "Payment" section below).

ISSUANCE OF A QUOTE

​

Upon receiving the reservation request, Platinum Paris provides a quote based on the information provided by the Client or the Passenger.

Any changes in the information transmitted may modify the initial price of the service (change of vehicle model, capacity, mileage, exceeding duration, etc.). Additionally, any service not included in the quote will be billed in addition to it.

CONFIRMATION OF RESERVATION

​

If the quote is accepted, the Client must confirm their reservation in writing to Platinum Paris by a means approved by the latter (the "Reservation Confirmation").

Platinum Paris's receipt of the Reservation Confirmation constitutes the formation of the transportation contract between Platinum Paris and the Client.

RATES

​

The services are offered at the rates indicated in Platinum Paris's pricing grid attached to the quote.

Rate rules may vary depending on circumstances such as holidays, peak periods, pick-up and/or service usage area, time of day, etc.

Rates are stated all taxes included (VAT) and include:

  • Chauffeur service,

  • Fuel,

  • Professional liability insurance for passengers transported for a fee.

Additionally, additional fees may be charged for specific requests such as extra stops, extended waiting hours, or requests for special services.

In case of non-compliance with payment conditions, late penalties may be applied.

Payments can be made by credit card, bank transfer, or cash, and an invoice will be issued for each service.

PASSENGER PICKUP

​

The Passenger(s) must comply with the pick-up rules indicated by Platinum Paris and/or the Driver assigned to perform the Service. Platinum Paris's liability cannot be incurred if the Passenger(s) fails to comply with the pick-up procedure, preventing the completion of the Service.

The highway code requires passengers to fasten their seat belts in the front and rear of the vehicle. Non-compliance with this rule absolves Platinum Paris of liability in case of an accident.

Platinum Paris maintains a strict non-smoking policy in all its vehicles. Failure to comply with this provision will result in cleaning and refurbishment fees of a lump sum amount equal to €250 including VAT.

Unless expressly and in writing authorized by Platinum Paris, the consumption of alcohol is not allowed in the vehicles. The Driver and/or Platinum Paris have the right to refuse to transport any Passenger believed to be under the influence of alcohol or drugs and whose behavior poses a threat to the driver, the car, or any other passenger.

Platinum Paris may choose to subcontract, transfer, or assign all or part of the Service to a third party of its choice without prior notice to the Client.

The photographs and images available on the Platinum Paris website, its brochures, and any presentation documentation are not contractual. Platinum Paris will not be responsible if the car and/or driver do not correspond to the photographs or images.

Platinum Paris declares that the vehicles assigned to the provision of the Services are equipped with a geolocation system. By accepting Platinum Paris's services, the Client consents to the use of this geolocation system.

BAGGAGE POLICY

​

The total weight of luggage is limited to what is compatible with the vehicle used, within the limits of the accessible space. The driver and/or Platinum Paris may refuse luggage or items exceeding this capacity. In particular, for safety reasons, Platinum Paris will refuse to load any bulky luggage into the passenger compartment. Platinum Paris will not be held responsible for any loss of luggage during or after the Service. The Passenger's personal effects are the responsibility of the Passenger, and Platinum Paris will not be held responsible for any loss or damage to these effects.

VEHICLE CAPACITY – NUMBER OF PASSENGERS TRANSPORTED

​

The maximum number of passengers in the car (including the Driver) must not exceed the maximum number of passengers specified in the vehicle's technical specifications. The Driver and/or Platinum Paris reserve the right to refuse a passenger exceeding these limits.

 

PETS

​

Small dogs and other small pets weighing no more than 6 kg, properly enclosed in a container not exceeding 45cm x 30cm x 25cm, are accepted on board vehicles, up to two pets. Subject to this condition, no other pets are allowed on board vehicles.

 

MODIFICATION AND CANCELLATION OF RESERVATION

Requests for modification or cancellation are made following the procedures authorized for booking Services.

Any modification or cancellation of the reservation must be made with Platinum Paris at least two (2) hours before the scheduled Service time.

Beyond these deadlines, Platinum Paris will invoice all or part of the reserved Service according to the following terms:

 

CONDITIONS APPLICABLE TO ALL SERVICES

​

All external ancillary fees incurred by Platinum Paris (guides, hostesses, security agents) as part of a Service canceled less than 24 hours before the scheduled start time will be fully invoiced.

​

CONDITIONS APPLICABLE TO ALL SERVICES PERFORMED IN SEDAN, MINIBUS, AND VAN:

​

In case of late cancellation (less than two hours before the agreed Service time) or non-appearance 60 minutes after the scheduled meeting time during the reservation of the Service, the Client will be charged the higher amount between the transfer price from the planned pick-up location to the garage on the one hand, and the actual time spent waiting for the Client at the meeting place on the other hand.

In case of reservation modification, the actually provided Service will be invoiced.

CONDITIONS APPLICABLE TO ALL SERVICES PERFORMED IN COACHES WITH MORE THAN 9 SEATS:

​

In case of late cancellation (less than two hours before the scheduled Service time) or non-appearance 60 minutes after the scheduled meeting time during the reservation of the Service, the Client will be charged the total amount of the originally planned Service multiplied by the following percentage:

  • Between 72 hours and 48 hours before the start of the Service: 10%

  • Between 48 hours and 24 hours before the start of the Service: 50%

  • Less than 24 hours or Non-appearance: 100%

Platinum Paris reserves the right to apply different cancellation or modification conditions, especially during peak periods or for Services requiring a large number of Vehicles. These special conditions will be specified in the quote or order summary received by the Client and will prevail over these provisions.

DRIVER DELAY

​

The driver is considered late if he arrives after the appointment time set during the reservation of the service. In case of delay, Platinum Paris contacts the client to inform them of the delay and, if it is impossible to pick up, offers an alternative solution. In the absence of an alternative solution, the client may be compensated, indemnified, or refunded, provided that the refunded amount, as well as the liability of Platinum Paris, will be limited to the predetermined amount of the reserved service or, when not determined, to a maximum of 150 euros.

 

CLIENT DELAY

​

The driver must wait for the client for 60 minutes after the meeting time. After this period, the client not present at the pick-up point is considered absent ("no-show"). In this case, the client will be charged the higher amount between the transfer price from the planned pick-up location to the garage, on the one hand, and the actual time spent waiting for the client at the meeting place, on the other hand.

 

COMMITMENT AND LIABILITY

​

Platinum Paris acts as a passenger transport company with drivers and declares to comply with the current professional regulations.

It assumes the security obligation that any professional transporter owes to the transported persons as well as the responsibilities related to the control of the passenger transport vehicle, whether it is the owner or lessee.

Platinum Paris declares to have a liability insurance contract covering its professional liability for the exercise of the passenger transport activity and especially all pecuniary consequences of bodily injuries.

DAMAGE

​

The Client is responsible for any damage caused by them or by the persons accompanying them in the car (except the Driver) or the Passenger(s) during the Service, inside the Car, and will be charged accordingly for any repairs or breakdowns necessary to restore the Car to good working order and/or cleanliness and/or presentation.

​

PAYMENT, PAYMENT, AND DOCUMENTATION

​

SERVICE PAYMENT TERMS

​

Platinum Paris accepts the following payment methods: cash, credit cards (Visa, American Express, Diners Club, MasterCard), bank transfers (fees to be borne by the issuer).

At the time of booking the Service, the Client must provide the following documents:

  • Valid credit card numbers (including the cryptogram)

  • A copy of their identity card, passport, or any equivalent document.

Before the Service is carried out, Platinum Paris checks with the Client's bank that their account is funded up to the amount of the Service. Platinum Paris may be required to debit a symbolic amount (<10 €) to verify the validity of the credit card provided as collateral (this amount being deducted from the final invoice).

Platinum Paris may also request a pre-authorization for the debit of the estimated amount of the Services from the Client's bank.

In case the card provided as collateral is invalid or the account to be debited is not funded, the reservation made by the Client cannot be confirmed by Platinum Paris, and the Service subject to said reservation will not be executed.

Any payment by American Express will be subject to a payment fee of 3.0% (three percent) of the invoice amount.

 

BILLING - PAYMENT

​

The Service will be invoiced from the date mentioned in the Reservation. Platinum Paris will send the Client the final invoice for the Service by email, taking into account any additional fees or applicable modifications.

The Service is payable in cash upon completion. The Client is informed that the debit may occur immediately after the execution of the Service.

In the case of Services performed over several consecutive days, Platinum Paris may debit the estimated amount of the Service from the previous day each day, with Platinum Paris being responsible for adjusting the final amount based on the Services invoiced. If the transported person has the status of a "credit customer," the Service will be invoiced payable upon receipt, before the 15th of the month following its execution, unless expressly stated otherwise.

LATE PAYMENT

​

Any delay in payment automatically leads, from the day following the payment date indicated on the invoice, to the payment of penalties of an amount at least equivalent to three times the legal interest rate, as well as the application of a lump-sum indemnity for administrative collection costs of a lump-sum amount of €40 excluding tax per unpaid invoice ("the Penalties"), in accordance with the provisions of Article L441-6 of the Commercial Code.

In case of non-payment, Platinum Paris reserves the right to take any necessary legal action to recover the amounts due, as well as to suspend any ongoing or future provision until full payment of the unpaid invoice. The Client will also be responsible for all costs incurred for the recovery of the debt, including attorney fees and legal costs.

In case of dispute over the amount of the invoice or the terms of the Service, the Client may send a complaint by registered letter with acknowledgment of receipt (LRAR) to PLATINUM PARIS at the following address :

Any claim is only admissible within 8 days of the execution of the Service concerned and in writing; otherwise, it will not be taken into account. Failure to comply with these deadlines will constitute a waiver by the Client to their claim.

PERSONAL DATA

​

These terms are subject to regulations regarding the protection of personal data (especially Regulation (EU) 2016/679 of April 27, 2016, and the "information technology and freedoms" law n°78-17 of January 6, 1978).

Personal data collected by Platinum Paris during the reservation and provision of services (especially through the geolocation system equipped in vehicles) includes:

  • Identification data as well as the postal, telephone, and electronic contact details of the Client;

  • Email and telephone details of the Passenger(s);

  • Payment method information;

  • Data related to the movements and location of the vehicle;

  • Data related to the speed of the vehicle and the distance traveled.

 

PROCESSING PURPOSES

​

The purposes of processing this data by Platinum Paris are:

  • Preparation and execution of the contract, including:

    • Management of service reservations and confirmation;

    • Monitoring and invoicing of services;

    • Emergency calls in case of incidents or accidents;

    • Management of complaints;

    • Combatting fraud.

  • Pursuing the legitimate interest of Platinum Paris in terms of promotion and prospecting, including:

    • Customer relationship monitoring (maintaining customer satisfaction, customer loyalty);

    • Statistical analysis and/or commercial analysis;

    • Transmission of advertising information or commercial offers to propose goods or services similar to those covered by these terms.

Platinum Paris may use the personal data provided by the client to send advertising information or commercial offers from its commercial partners only if it has obtained the client's consent.

By accepting these general conditions, the client agrees to the collection and processing of the aforementioned personal data for the purposes mentioned above, by Platinum Paris, the data controller.

DATA RETENTION

​

Platinum Paris records and retains personal data related to the service for a period of three (3) years from the reservation.

After this period, the aforementioned personal data may be archived by Platinum Paris to enable compliance with accounting, tax, and legal obligations (including a 5-year prescription period applicable to the contract/Article 2224 of the Civil Code; a 10-year period for the conservation of invoices/L123-22 of the Commercial Code).

Platinum Paris has technical means to ensure the confidentiality and security of the collected data.

CLIENT'S RIGHTS

​

The client has the right to access the data concerning them. They can request at any time:

  • Rectification, updating, and/or deletion of their personal data;

  • Limitation of the processing of their data;

  • Portability of their data;

  • Objection to the processing of their data for legitimate reasons.

The client must attach proof of identity to exercise the above-mentioned rights. Platinum Paris undertakes to respond to the client's request as soon as possible and no later than one month from the date of receipt of the request. If the request is complex or if Platinum Paris receives a large number of requests, this period may be extended by two months. In such cases, the client will be informed of the extension and the reasons for the delay. The client can also file a complaint with the CNIL in case of unlawful processing of their personal data.

INTELLECTUAL PROPERTY

​

The Platinum Paris website, including but not limited to photographs, graphics, the client interface, editorial content, scripts, and software, contains information and elements owned by Platinum Paris and/or its subcontractors, protected by intellectual property law. The client expressly acknowledges that they must not use this information or documents except for use in accordance with the General Conditions. The client must not copy, reproduce, display, or use any element of the Platinum Paris website protected by intellectual property in any way without the prior written consent of Platinum Paris. The client must not establish a connection, including through a hyperlink, "mirror," electronically or otherwise, to any part of the website or an application without the prior written consent of Platinum Paris.

APPLICABLE LAW

​

The General Conditions and any related contract are exclusively executed, governed, and interpreted in accordance with French law.

In the event of a discrepancy or conflict between the English and French versions of the General Conditions, the French version will prevail. The English version is provided for informational purposes only.

In the event of a dispute, the client will contact Platinum Paris to seek an amicable resolution to their complaint.

Any dispute that cannot be settled amicably will be:

  • Subject to the exclusive jurisdiction of French courts if the client is a consumer;

  • Subject to the exclusive jurisdiction of the Commercial Court of Créteil if the client is a merchant.

If one or more provisions of these General Sales Conditions are declared null or unenforceable, the other provisions will retain their full force and scope.

VERY IMPORTANT

​

The paid transport of people is a regulated activity. Only authorized vehicles (Chauffeur-driven Car; Occasional Transport) can provide this service, following the legal and regulatory provisions.

We would like to caution our clientele against certain companies or individuals who do not adhere to these provisions and cannot offer any guarantees.
